AB 1071, authored by Assemblymember Kalra, will make clarifying changes to the procedures for Racial Justice Act (RJA) claims. It will do four (4) things: The bill will affirm a low threshold for appointing an attorney. It will ensure access to relevant information for petitioners to assert RJA claims. It will ensure there is a method for filing post-conviction RJA claims, separate from a habeas petition. It will also provide more options for the remedies available after the court’s finding of an RJA violation.
